Privacy collection statement

 

Essence Communications Ltd (NZ company number 2119052) and its Related Bodies Corporate (as defined by the provisions of the Corporations Act 2001 (Cth)) (Essence, we, us and our) are committed to protecting the privacy of individuals and their personal information and complies with the Australian Privacy Act 1988 (Cth) (hereinafter the Privacy Act).

Please read this carefully as it will have important consequences for you in relation to the collection, use and disclosure of your personal information (including credit information, where applicable) you provide to Essence.

You understand that:

  1. Amgen has appointed Essence to collect your contact details so that it can send you disease education messages. If you have any questions relating to your data privacy, please contact our Privacy Officer via email privacy@amgen.com. Further details are set out in Amgen’s Privacy Statement. This privacy statement explains how Amgen Australia handles your personal information. Essence is the party who is collecting your personal information and can be contacted at privacy@essenceagency.co.nz or alternatively you can write to us at Level 3 / 33 Federal Street, Auckland CBD 1010, New Zealand.
  2. Essence will collect your personal information directly from you. In certain circumstances, Essence may collect personal information from third parties, such as your nominated health professional and other providers involved in the delivery of the Wellbean Program.

  3. The purpose of Essence Communications Ltd collecting and using your personal information is:

    • (a) to enrol you and ensure your continuing eligibility in the Wellbean Program;

    • (b) to manage your participation in the Wellbean Program, including arranging counselling services, as may be applicable;

    • (c) to contact you in relation to adverse health events;

    • (d) to contact you regarding your interest in participating in market research for the Wellbean Program;

    • (e) to report to Amgen Pty Ltd (ABN 31 051 057 428) (Amgen) any self-reported adverse events that arise from you taking Amgen medication for anaemia caused by chronic kidney failure; 

    • (f) to ensure that relevant medical information is communicated with your nominated Nephrologist and other supporting healthcare professionals involved in your care within your clinic or practice; and

    • (g) to offer you updates on events or information that may be of interest to you, such as email alerts, reminders and to provide you with direct marketing communications from us or our related entities and associates (using email, SMS, and MMS messages).

    And you acknowledge and consent to your personal information being collected and used for, and in connection with, these purposes and any other purpose described in our Privacy Policy.

  4. If we do not collect this personal information in connection with the purposes in paragraph 3,

    • (a) Essence will be unable to facilitate the management of your participation in the Wellbean Program;

    • (b) we will be unable to relay important medical information to your nominated healthcare professionals within your clinic or practice; and

    • (c) we will be unable to send you direct marketing communications (unless you have consented to such communications through your other dealings with Essence).

  5. Your personal information may be disclosed to the following classes of people and organisations in connection with purposes in paragraph 3:

    • (a) Essence, its personnel and related entities;

    • (b) your nominated Nephrologist and other supporting healthcare professionals involved in your care within your clinic or practice;

    • (c) third party service providers including without limitation marketing service providers, IT services providers, contractors and sales consultants and other parties who assist us in responding to your enquiry and providing our products and services to you;

    • (d) when it is required or authorised by law;

    • (e) when it is necessary to lessen or prevent a serious threat to a patient’s life, health or safety or public health or safety, and it is unreasonable or impractical to obtain the patient’s consent; and

    • (f) any relevant eHealth services such as My Health Record (e.g. via Shared Health Summary, Event Summary), eTP or Medicare.

  6. Essence is based in New Zealand. Accordingly, the information collected via any enrolment form will be disclosed outside of Australia to us in New Zealand, and some personal information may additionally be disclosed to our related bodies corporate and service providers in other overseas destinations. You consent to your information being disclosed to a destination outside Australia for this purpose and you understand and acknowledge that the Australian Privacy Principle 8.1 will not apply to such disclosures of your information.

  7. Essence’s Privacy Policy sets out the process as to how you can access and correct any of your personal information collected under this form as well as how you can make a complaint if Essence has breached the Privacy Act in the handling of your personal information.   8. By continuing with your enrolment into the Wellbean Program, you indicate that you have read this collection notification and acknowledge that your personal information will be collected, used and disclosed in accordance with this collection notice and as otherwise detailed in Essence’s Privacy Policy and, to the extent it is necessary, that you give your voluntary express consent to Essence collecting, using, storing, disclosing and disposing of your personal information in this manner.
